Welcome to Altered Brilliance.

These Terms of Use (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Kri Zek LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the Altered Brilliance mobile application (the “App”) and our website at krizek.tech.

By accessing the App, you confirm that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND MUST DISCONTINUE USE IMMEDIATELY.

1. Intellectual Property Rights

Unless otherwise indicated, the App is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.

This includes specific proprietary methodologies such as the TGIX™ (The Gamer Index) algorithm, the Archetype System, and the Alteration framework. You are granted a limited license to access and use the App for your personal, non-commercial use.

2. User Representations

By using the App, you represent and warrant that:

All registration information you submit will be true, accurate, current, and complete.
You are at least 13 years of age.
You will not access the App through automated or non-human means, whether through a bot, script, or otherwise.
You will not use the App for any illegal or unauthorized purpose.

3. Subscriptions and Payments

Altered Brilliance offers a free tier and paid subscription tiers (e.g., Premium, Ultra Gamer).

Billing: Subscriptions are managed and billed by the applicable app store (Apple App Store or Google Play Store). By purchasing a subscription, you authorize the App Store to charge your payment method.
Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Cancellations: You can cancel your subscription at any time through your Apple ID or Google Play account settings. We cannot cancel subscriptions on your behalf.
Refunds: All refund requests must be directed to the Apple App Store or Google Play Store, as they process the payments. We do not issue direct refunds.

4. Artificial Intelligence (AI) Disclaimer

Our App utilizes artificial intelligence (powered by Google Gemini) to provide personalized Weekly Insights and performance analysis.

No Guarantee: AI is an evolving technology. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated insights or text.
Not Professional Advice: The insights provided by the TGIX™ algorithm and our AI features are for informational and entertainment purposes only. They do not constitute psychological, medical, or professional life coaching advice.

5. Medical and Wellness Disclaimer

Altered Brilliance provides meditation, focus training, and wellness content ("Zen Mode," "Focus Sessions").

Not a Medical Device: The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Consult a Professional: Always seek the advice of your physician or other qualified health provider regarding a medical condition or before starting any new wellness or mental training regimen.

6. User-Generated Content

The App allows you to create reflection notes, logs, and other content ("User Content"). You retain ownership of your User Content. By submitting it, you grant us the right to process this content (including via our AI processors) solely to provide the App's functionality and generate your insights.

7. Prohibited Activities

You may not:

Systematically retrieve data or other content from the App to create a collection, compilation, database, or directory without written permission from us.
Attempt to bypass any measures of the App designed to prevent or restrict access to the App, or any portion of the App (e.g., bypassing premium paywalls).
Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the App.

8. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the App at any time or for any reason at our sole discretion without notice. We cannot guarantee the App will be available at all times. We may experience hardware, software, or other problems resulting in interruptions, delays, or errors.

9. Governing Law

These Terms shall be governed by and defined following the laws of the State of Delaware, United States. Kri Zek LLC and yourself irrevocably consent that the courts of Delaware shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

10. Dispute Resolution & Arbitration Binding Arbitration

Any dispute arising from your use of the App will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You and Kri Zek LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
